1. Introduction and Acceptance of Terms

1.1 Purpose
Welcome to The Audition Guide (“we,” “our,” or “the Site”). This User Agreement (“Agreement” or “Terms”) governs your use of our website, services, and any associated applications, plugins, or tools. By creating an account, accessing, or using the Site, you agree to comply with these Terms.

1.2 Applicability
These Terms apply to all users, including:

  • Dancers: Individuals accessing free or paid membership tiers.
  • Companies: Organizations managing profiles and posting auditions.
  • Schools: Institutions managing their page and posting auditions.
  • Resources: Professionals or businesses offering dance-related products or services.

1.3 Updates
We may update these Terms from time to time. Updates will be communicated on the Site or via our Legal Hub. Continued use after updates constitutes acceptance.

1.4 Legal Acknowledgment
By using The Audition Guide, you confirm that:

  1. You have read, understood, and agreed to these Terms.
  2. You are legally capable of entering into a binding agreement.
  3. If under 16, a parent or guardian has created your account on your behalf.

2. User Categories and Subscription Rights

2.1 Dancers

  • Corps de Ballet (Free): Profile creation, save auditions, access to basic features.
  • Soloist (Paid): All free features plus additional resources, premium tools, and priority support.
  • Principal (Paid): All Soloist features plus full premium access and exclusive benefits.
  • Subscriptions: monthly, 3-month, or yearly.

2.2 Companies

  • Free: Limited profile, basic visibility.
  • Paid: Editable profile (content fields only, layout set by us), ability to post auditions, enhanced visibility.
  • Subscription: yearly.

2.3 Schools

  • Paid: Dedicated profile page, ability to post auditions, premium visibility.
  • Subscription: yearly.

2.4 Resources

  • Paid: Profile page for dance-related professionals, apps, studios, or services.
  • Subscription: monthly or yearly.

2.5 Subscription Terms

  • All paid subscriptions automatically renew unless cancelled before the renewal date.
  • Users can cancel anytime via account settings; access remains until the end of the paid period.
  • Free trials convert into paid subscriptions unless cancelled before the trial ends.
  • Discounts and promotions are time-limited and subject to specific terms.
  • Prices include applicable VAT; taxes are calculated based on billing address.
  • Payments are processed by SureCart through third-party providers (e.g., Stripe, PayPal). To complete a purchase, you may need to agree to the terms and conditions of these providers in addition to this Agreement. We do not store payment details.

2.6 Refunds and Withdrawal

  • Under EU law, you have a 14-day withdrawal right from purchase.
  • For monthly dancer subscriptions, this right is waived by default as you receive immediate access to digital content.
  • We may instead offer a free trial period (e.g., 7 days) as an alternative.
  • Refund requests outside this period are not guaranteed and handled at our discretion.

2.7 Account Rules

  • Accounts are personal and non-transferable.
  • Sharing, selling, or transferring accounts is strictly prohibited.
  • Accounts may be suspended or terminated for violations of these Terms.

3. Services and Plugins – Data Collection

We use third-party services and plugins to operate our Site. These may collect and process personal data as follows:

  • Nextend Social Login (Dancers only): Collects name, email, social ID, profile picture, access token. Data stored locally; cookies used for login flow.
  • Forminator Forms: Collects IP, name, email, and submitted data. Integrated with Google reCAPTCHA and hCaptcha for spam protection.
  • hCaptcha: Spam and bot detection; analyzes user behavior. Data sent to Intuition Machines, Inc.
  • SureCart: Collects billing and payment data, IP for fraud prevention. Data shared with payment processors (Stripe, PayPal).
  • SureMembers / User Verification: Stores membership status, access rights, email verification. Data stored locally.
  • WP Mail SMTP: Logs emails, sender info, and IPs. Sent to chosen SMTP provider.
  • Google Site Kit / Analytics: Tracks user behavior and IPs. Data sent to Google services.
  • Wordfence Security: Collects IPs, login data, and threat information. Data may be shared with Wordfence for security purposes.
  • Frontend Reset Password: Collects email and IP for password resets; tokens expire after use.
  • Elementor & JetEngine: Stores interaction data (button clicks, form submissions) in a local datastore.

4. Privacy and Data Retention

  • Personal data is retained only as long as necessary.
  • If you delete your account, data is removed within 30 days, unless required for fraud prevention, accounting, or legal compliance.
  • Cookies, tokens, and local storage may be used to improve your experience.
  • Marketing emails (via Sender.net or other providers) are sent only with your explicit consent. You can unsubscribe at any time.

5. Content Ownership and Rights

  • You retain ownership of all content you upload (profiles, audition posts, resources).
  • By submitting content, you grant The Audition Guide a non-exclusive, worldwide, royalty-free license to use, display, and promote your content on the Site and in marketing.
  • This includes use in social media, newsletters, and email marketing when promoting your profile, post, or organization.
  • We reserve the right to moderate or remove content that violates these Terms or applicable law.

Directory Disclaimer
The Audition Guide also compiles and publishes publicly available information (e.g., company names, director names, websites) to build our free directory for dancers. While we strive to keep this accurate, we cannot guarantee it is always up to date. This information is provided for informational purposes only and remains the property of the respective organizations.


6. User Obligations

All users must:

  1. Provide accurate and up-to-date information.
  2. Use the Site lawfully and respectfully.
  3. Not engage in fraud, impersonation, or misleading activities.
  4. Respect the rights and privacy of other users.

7. Limitation of Liability

  • The Site provides information, profiles, and audition postings “as is.” We do not guarantee accuracy, availability, or suitability for your specific needs.
  • We are not responsible for outdated, incorrect, or incomplete directory listings or audition posts. Users should verify directly with the organization.
  • We are not responsible for third-party services, plugins, or external links.
  • To the extent permitted by law, our liability is limited to the amount you paid for your subscription during the 12 months prior to the claim.

8. Modifications and Termination

  • We may update, suspend, or discontinue parts of the Site at any time.
  • Users will be notified of significant changes to these Terms.
  • If you do not agree to changes, you must stop using the Site and cancel your account.

9. Governing Law and Jurisdiction

  • These Terms are governed by the laws of Germany, without prejudice to mandatory consumer protections under the law of your country of residence.
  • Any disputes shall be resolved in the competent courts of Berlin, Germany, unless otherwise required by consumer law.
